DiabloBytes respects the intellectual property rights of others and expects users of diablobytes.com to do the same. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and will respond to valid notices of copyright infringement.

1. Reporting Copyright Infringement

If you believe that content on DiabloBytes infringes your copyright, please send a written takedown notice to our Designated Agent (contact information below). Your notice must include all of the following elements as required by 17 U.S.C. § 512(c)(3):

  1. Your signature. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed, or if multiple works are covered, a representative list.
  3. Identification of the infringing material. A description of the material you claim is infringing and its location on the Site (e.g., a specific URL) with sufficient detail for us to locate it.
  4. Your contact information. Your name, address, telephone number, and email address.
  5. Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy statement. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability. Please ensure your claim is valid before submitting a notice.

3. Counter-Notification Process

If you believe that material you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g). Your counter-notification must include:

  1. Your signature. Your physical or electronic signature.
  2. Identification of the removed material. Identification of the material that was removed and the location where it appeared before removal (e.g., the URL).
  3. Statement of good faith. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your contact information. Your name, address, and telephone number.
  5. Consent to jurisdiction. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Travis County, Texas if outside the U.S.), and that you will accept service of process from the person who submitted the original takedown notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed material no sooner than 10 business days and no later than 14 business days after receipt, unless the original complainant notifies us that they have filed a court action seeking to restrain you from engaging in infringing activity.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, DiabloBytes maintains a policy of terminating access for users who are repeat infringers in appropriate circumstances.

When user accounts are added to this Site, we will track DMCA notices associated with user-submitted content and take appropriate action — including account termination — against users who repeatedly infringe third-party intellectual property rights.

5. Note Regarding Game Content

DiabloBytes is a fan site that presents factual game data and original editorial content about Blizzard Entertainment's Diablo franchise. We do not reproduce Blizzard's creative works verbatim, do not host game files or executables, and operate under principles of nominative fair use and factual data use.
