These Terms of Use ("Terms") govern your access to and use of diablobytes.com (the "Site"), operated by DiabloBytes ("we," "us," or "our").

By using the Site, you represent that you are at least 13 years of age and have the legal capacity to agree to these Terms. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. About DiabloBytes

DiabloBytes is an unofficial fan site created by and for fans of the Diablo franchise. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected to Blizzard Entertainment, Inc. or its parent company Activision Blizzard, Inc.

The Site provides game guides, builds, tools, news, and community resources for fans of the Diablo franchise. Content is provided for informational and entertainment purposes only.

Original content on this Site — including site design, original written guides, editorial articles, custom tools, and source code — is owned by or licensed to DiabloBytes and is protected by copyright and other intellectual property laws. Game data presented on this Site (item stats, runeword recipes, skill information, etc.) is presented for informational and fan community purposes. We display this content under principles of nominative fair use and factual data use. We are not affiliated with or endorsed by Blizzard Entertainment.

3.3 Third-Party Content

Some content on this Site is contributed by community members or sourced from third parties with appropriate attribution (e.g., the Diablo II speedrun guide originally authored by Nightfallx2/Void). Such content remains the property of its respective creators.

We do not control those sites and are not responsible for their content, privacy practices, or availability. A link does not imply endorsement. You access linked sites at your own risk.

6. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

Game data, build recommendations, and other content may be outdated, incomplete, or inaccurate. Diablo games receive frequent patches and balance changes. Always verify critical information in-game or through official Blizzard sources. We make no guarantee that the Site will be available, error-free, or uninterrupted.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIABLOBYTES AND ITS OWNERS, OPERATORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You consent to personal jurisdiction in those courts.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the Site.
